I can't speak for where the lawsiut is taken place, but it's labled everywhere up here. It's in the commercials, they mention it when you actually rent the movie, and it's plastered everywhere in the store.

When you rent ANYTHING, they give you a FAQ and terms of the "No more Late Fees" policy.
